TaibahGift is an online marketplace that allows individuals and businesses to browse and purchase a wide variety of curated gifts. It also enables eligible sellers to list and offer their products for sale.

We may modify, update, or discontinue any part of our Services at our sole discretion and without any liability to you.

2. Eligibility and Registration

For Buyers:

  • You must be of legal age in your country of residence.

  • You must be able to provide a delivery address within the Kingdom of Saudi Arabia.

For Sellers:

  • You must operate a legally registered business in your jurisdiction.

  • You must hold a valid commercial license.

  • You must provide documentation authorizing the individual registering on behalf of the business.

  • Bank account information must be submitted for transactions.

TaibahGift reserves the right to approve, suspend, or reject registration requests at its sole discretion. We may verify your identity and request additional information at any time.

3. User Responsibilities

By using our Services, you agree to:

  • Keep your account information and password secure.

  • Accept responsibility for all activities carried out through your account.

  • Notify us immediately of any unauthorized access or security breach.

  • Provide accurate, complete, and up-to-date information.

  • Cooperate with any verification or compliance requests we may issue.

4. Prohibited Activities

You agree not to engage in any of the following while using our Services:

  • Posting or selling any items that violate laws, ethics, Islamic values, or public morals.

  • Listing hazardous or prohibited items such as weapons, counterfeit goods, controlled substances, or expired products.

  • Promoting gambling or unlicensed financial instruments.

  • Uploading harmful, misleading, or infringing content.

  • Engaging in price manipulation, spam, fake reviews, or interfering with other users' listings.

  • Circumventing the platform to conduct transactions externally.

  • Attempting to hack or disrupt our technical systems.

5. Intellectual Property

All content on the Website — including text, graphics, logos, images, digital downloads, and software — is the property of TaibahGift or its licensors and protected under intellectual property laws.

6. Warranties and Disclaimers

We do not guarantee that the content on the Website is accurate, complete, or up to date. As a buyer, you acknowledge that we are not responsible for verifying listings or products from third-party sellers. As a seller, you are solely responsible for the accuracy and legality of your listings.

7. Limitation of Liability

To the fullest extent permitted by law, TaibahGift, its affiliates, directors, employees, or licensors shall not be liable for:

  • Lost profits, data, or business interruption.

  • Indirect, incidental, or consequential damages.

  • Any damages exceeding the lesser of:

    • The product purchase price plus original shipping charges,

    • The disputed fee (if applicable), or

    • 300 SAR.

8. Indemnification

You agree to indemnify and hold harmless TaibahGift, its parent company, subsidiaries, affiliates, officers, employees, agents, and licensors against any claims, losses, or damages (including legal fees) arising from:

  • Your violation of these Terms or any related policies.

  • Your violation of applicable laws or third-party rights.

  • Content you post, products you list, or actions you take through our platform.

9. Account Suspension or Termination

Without limiting any other rights or remedies, we may suspend, restrict, or terminate your access to the Services at any time — including canceling orders or removing listings — at our sole discretion. Any payments collected for canceled orders will be refunded.

10. Governing Law and Dispute Resolution

These Terms of Use and any non-contractual obligations arising from or in connection with them shall be governed by the laws of the Kingdom of Saudi Arabia.

Disputes shall be resolved exclusively in the competent courts of Saudi Arabia. You are encouraged to contact us first to attempt informal resolution.

11. General Provisions

  • Relationship: Nothing in these Terms shall be interpreted as a partnership, joint venture, or agency between the parties.

  • Entire Agreement: These Terms and related policies constitute the entire agreement between you and TaibahGift and override any prior agreements.

  • Assignment: You may not assign or transfer your rights under these Terms without our written consent.

  • Severability: If any provision is deemed unenforceable, the remaining provisions shall remain valid and enforceable.

  • Force Majeure: We are not liable for delays or failures resulting from causes beyond our control, including natural disasters, legal restrictions, or third-party service disruptions.

  • No Waiver: Our failure to enforce any part of these Terms shall not constitute a waiver of our rights.
